search , arrest

on january 24, 2002, fbi , secret service armed search warrant raided austin s home. agents seized of political literature , computer equipment, including webservers used distribute explosives information. while searching austin s bedroom, agents discovered 2 glass bottles containing petroleum products; 1 of these bottles had metal screw top hole punched in lid , other contained piece of burnt material. agents found boxes containing 63 glass bottles, , remote controlled detonation device fashioned toy car. austin s car contained fertilizer, cans of brake fluid, , 2 gas canisters.


a week later austin attended anti-world economic forum protests in new york city arrested fbi distribution of information relating explosives, destructive devices , weapons of mass destruction. when arrested, austin carrying black mask, gas mask, , lighter; car contained empty gas canister, electrical wiring, , duct tape. asked released travel trial jurisdiction on own, federal prosecutor argued austin s alleged vow take violent action stop 2002 olympics , burn event posed serious threat. federal magistrate henry pitman ruled austin remain in custody trip california.


conviction

on august 4, 2003, after entering guilty plea under agreement prosecutor, austin sentenced in u.s. district court judge stephen v. wilson 12 months in federal jail, $2000 fine, , 3 years probation, , other restrictions. time served in federal institution in tucson, arizona.


austin has claimed never authored explosives information, although freely hosted on webserver. says took plea deal because of possibility of 20-year sentence due terrorism enhancement clause in usa patriot act.


austin not indicted alleged hacking crimes. however, has acknowledged defacing sites, saying necessary message out.


release

austin released 1 month in july 2004 3 years of probation prohibited him having access computer or knowingly associating individuals espouse violence political change .


following release prison, released hip-hop cd, silence defeat.


in february 2006, austin released statement on indymedia containing claims national security agency had installed illegal wiretaps before , during investigation against him, , nsa, along other higher-ups in government , arranged 3 separate attempts assassinate him. austin says anonymous informants provided him detail on serving contracts, names, license plate numbers, etc , anonymous informants, , these informants assured him being taken care of , being looked out .
